Terms of Use

These Terms of Use ("Terms") govern your access to and use of the B99: Bitcoin Mining APP mobile application (the "App"), operated by B99 Technologies Ltd ("Company", "we", "us", or "our"). The App and any features, content, tools, and services made available through it are the "Services".

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

0. Definitions

• "App" means the B99: Bitcoin Mining APP mobile application.

• "Rewards" means the in-app reward values we allocate to you under the program rules, recorded as an in-app balance.

• "Balance" means the in-app ledger entry reflecting Rewards allocated to your account minus any adjustments, reversals, or corrections permitted by these Terms.

• "Plan" / "Contract" means an in-app digital feature that may affect participation values used to allocate Rewards.

• "External Services" means third-party platforms used for distribution, billing, ads, analytics, or other integrations (for example Apple App Store, Google Play).

• "Associated Sites" means third-party websites, apps, channels, or services linked to or referenced from the App.

1. Translation Disclaimer

Translations are provided on an "AS IS" basis. The official text is the English language version. In the event of any discrepancy, the English version shall prevail. You acknowledge that translations may occasionally result in errors. We shall not be liable for any damages resulting from the use of translated content.

2. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date and may notify you via the App, email, or other reasonable means. Your continued use of the App after updated Terms take effect means you accept the updated Terms.

3. Who May Use the App

You must be at least 13 years old to use the App. Some features may require you to be at least 18 years old. The App is offered for personal, non-commercial use only.

You must not use the App if you are located in any country or region where use of such services is prohibited by law. We may restrict availability by geography, store policy, or other factors.

4. Accounts, Access, and Security

Some features require you to create or connect an account (for example, using Google or Apple sign-in). You are responsible for maintaining the security of your device, account credentials, and all activity under your account.

You must not share accounts, buy/sell accounts, or allow others to access your account. You must not use the App through unauthorized automation, bots, scripts, emulators, farms, or similar tools.

5. The Reward Program

5.1 Reward System

The App is a cloud-based Bitcoin mining simulation remote management utility. Rewards made available through the program are allocated to eligible users under our program rules. Users do not acquire rights in, or claims to, any specific mining hardware, pool account, mining output, revenue stream, or proceeds.

5.2 Plans, Contracts, and In-App Hashrate

Within the App, you may obtain Plans/Contracts (including free, rewarded, trial, promotional, and paid options). These values are internal program inputs used to allocate Rewards among users. They are not transferable property rights and do not grant you control of any specific mining hardware.

5.4 Why Rewards Can Change

Rewards are variable and may go up or down due to: Bitcoin network hashrate and difficulty changes; Bitcoin protocol and mining economics; Operational factors; In-app participation factors. Rewards are not guaranteed.

5.5 Program Adjustments

We may update the Services, add or remove features, and adjust program parameters. We may adjust or reverse benefits allocated to you if we reasonably believe they were assigned erroneously or obtained by misuse, fraud, or policy violations.

6. In-App Balance and Ledger

Your Balance is an internal ledger entry used to track Rewards allocated to your account under our rules. It is not a bank account, deposit, stored-value account, or e-money account, and it is not insured or guaranteed by any government authority.

If your Balance becomes incorrect due to error, abuse, refund, chargeback, reversal, or other reason, we may correct the Balance, reverse allocations, and adjust or forfeit associated benefits.

7. Purchases, Subscriptions, and Billing

Some purchases are processed through External Services (e.g., Apple App Store, Google Play). Billing, taxes, renewals, cancellations, and refunds are handled according to the rules of the relevant External Service.

If you purchase an auto-renewing subscription, your External Service account will be charged until you cancel. To cancel, you must do so through the relevant External Service account settings.

If a refund, chargeback, or payment reversal occurs, we may immediately revoke or restrict access to any features, Plans/Contracts, or benefits associated with that purchase.

8. Account Verification and Fraud Prevention

In rare cases, we may require additional account verification to prevent fraud, investigate security issues, protect account integrity, or comply with applicable law.

We may request limited information such as your name, date of birth, country of residence, and contact details. In exceptional cases, we may request identity documents and/or a selfie/photo for verification.

9. Prohibited Conduct

You must not:

• Use bots, scripts, automation, emulators, farms, or similar methods to manipulate Rewards, ads, referrals, or account creation;

• Create multiple accounts or attempt to bypass security controls;

• Abuse promotions, referral programs, or ad-based rewards;

• Reverse engineer, decompile, or attempt to extract source code;

• Use the App unlawfully or in a way that harms other users;

• Infringe intellectual property or misuse trademarks;

• Attempt to gain unauthorized access to systems or data;

• Use the Service to facilitate illegal activity.

10. Third-Party Services

The App may link to or reference Associated Sites (support channels, websites/apps, community channels). These are not operated by us. We do not endorse, control, or assume responsibility for Associated Sites. Your use of them is governed by their own terms and policies.

11. Intellectual Property

The App and all related software, content, trademarks, and logos are owned by B99 Technologies Ltd or its licensors and are protected by applicable intellectual property laws. All rights are reserved.

You may not publish, manipulate, distribute, reproduce, or create derivative works from any content supplied through the App, except where permitted by law.

14. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

We do not guarantee that the App will be uninterrupted, secure, or error-free, or that Rewards will be available at any specific level. Nothing in the Services constitutes financial, investment, legal, or tax advice.

15. Limitation of Liability

To the maximum extent permitted by law, B99 Technologies Ltd and its directors, officers, employees, affiliates, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of the App or Services.

16. Indemnity

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless B99 Technologies Ltd from and against any and all claims, liabilities, losses, damages, costs, and expenses arising out of or related to your use of the App or Services, your breach of these Terms, or any unlawful act by you.

17. Suspension, Termination

We reserve the right to withdraw, suspend, restrict, or amend the Services without notice. We may suspend or terminate access if you violate these Terms, if we suspect fraud or abuse, if required by law, or if necessary to protect the Service.

Upon suspension/termination, we may restrict access to features while we complete risk, fraud, and compliance checks. If your account is inactive for an extended period, we may classify it as dormant and restrict features or close the account.

18. Regulatory Compliance

You are responsible for understanding and complying with all legal restrictions in your jurisdiction related to the use of services like the App. You are solely responsible for determining what taxes, if any, apply to your use of the Services.

19. Dispute Resolution

If you have a complaint or dispute relating to Rewards, account issues, or Plan/Contract matters, contact support first using the details in the App or below.

For U.S. users: Binding Arbitration & Class Action Waiver applies. Before starting arbitration, you agree to contact us and attempt to resolve the dispute informally. You and B99 Technologies Ltd agree that any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA").

You may opt out of this arbitration agreement by sending an email to support@b99mining.com within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out".

To the fullest extent permitted by law, any claim must be filed within 12 months after the claim first arose.

20. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (for example, outages, network failures, third-party interruptions, changes in provider availability, or acts of government).

21-23. General Terms

• Assignment: You may not assign your rights without our consent. We may assign these Terms as part of corporate restructuring.

• Severability: If any provision is held invalid, the remaining provisions remain in effect.

• No Waiver: A waiver of any right is only effective if in writing and signed.

24. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, without regard to conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts of England and Wales, subject to any non-waivable consumer protection rights.

25. Privacy Policy

Our Privacy Policy explains how we collect, store, use, and disclose personal data. You can access it within the App or at b99mining.com.

26. Electronic Communications

You agree that we may communicate with you electronically (via the App, email, or push notifications) and that such communications satisfy any legal requirement that communications be in writing. You are responsible for keeping your contact details current.

27. Entire Agreement

These Terms (together with the Privacy Policy and any additional policies) constitute the entire agreement between you and us regarding the Services and supersede prior versions. If we provide translations, the English version controls if there is any inconsistency.

28. App Store / Platform Terms

Apple: If you use the App on iOS, you acknowledge these Terms are between you and B99 Technologies Ltd, not Apple. Apple has no obligation to furnish maintenance or support services for the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms.

Google Play: If you download the App from Google Play, you acknowledge that Google may be a third-party beneficiary of these Terms to the extent required by Google Play policies.

Billing, refunds, and subscription management for purchases made through Apple App Store or Google Play are governed by the applicable platform rules.
